A National Interest Waiver (NIW) petition for Permanent Residency is a second preference of an employment based EB2 immigrant visa category for United States.

Usually, a petitioner for an employment-based EB2 immigration category is required to possess a permanent job offer from a U.S.-based employer and an approved Labor Certification. However, NIW petition carries a “National Interest Waiver” tag, requesting for its petitioner to be exempt from the requirement that his or her employer first obtain a Labor Certification from the U.S. Department of Labor. In return, for the petitioner to be exempt from a Labor Certification requirement, him or her must demonstrate that their professional value/work will be in the “national interest” of the United States.

NIW petitioners are also required to meet one of the two EB2 category requirements, either to have an “advanced degree” (master’s degree or superior/a bachelor’s degree plus five years progressive work experience in the field) or “exceptional ability” in the sciences, arts or business.
